1. Acceptance of Terms

By accessing or using AI Diagram (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AI Diagram is a web-based application that uses artificial intelligence to generate diagrams, flowcharts, mind maps, and architecture diagrams from text descriptions. The Service includes both free and paid tiers.

3. Accounts

You may use certain features of the Service without creating an account. To access cloud sync, subscription plans, and credit purchases, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscriptions and Payments

Paid plans are billed on a recurring basis (monthly or yearly) through our payment provider, Paddle. By subscribing, you authorize recurring charges. You may cancel at any time; your plan remains active until the end of the current billing period.

Credit packs are one-time purchases. Purchased credits do not expire and are non-refundable except as described in our Refund Policy.

Prices are listed in USD and exclude applicable taxes. Paddle calculates and collects VAT, sales tax, or GST as required by your jurisdiction.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law.
Attempt to reverse-engineer, decompile, or disassemble the Service.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorized access to the Service or its systems.
Use automated means (bots, scrapers) to access the Service without permission.
Resell or redistribute the Service without authorization.

6. Intellectual Property

You retain ownership of all content you create using the Service, including diagrams and exported files. The Service itself, including its code, design, and branding, is owned by AI Diagram and protected by intellectual property laws.

7. AI-Generated Content

Diagrams generated by the Service are created using third-party AI models. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying all generated diagrams before use in production or professional contexts.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. When not signed in, all data is stored locally in your browser. When signed in, project data is synced to our cloud servers.

9. Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, AI Diagram shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
